1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and AbbarSarch Air Conditioning Services ("AbbarSarch," "we," "us," or "our") regarding your use of our website (abbarsarch.com) and services.

2. Description of Services

AbbarSarch provides professional air conditioning cleaning, disinfection, and maintenance services throughout Canada. Our services include:

  • Deep AC unit cleaning and disinfection
  • Mold and bacteria removal
  • HVAC system maintenance and inspection
  • Air quality testing and improvement
  • Emergency AC cleaning services
  • Preventive maintenance plans

All services are provided by licensed and insured technicians in accordance with Canadian industry standards and regulations.

3. Service Scheduling and Availability

3.1 Scheduling

Services must be scheduled in advance through our website, phone, or email. We will confirm all appointments and provide estimated arrival times.

3.2 Service Areas

We primarily serve the Greater Toronto Area and surrounding regions in Ontario, Canada. Service availability in other areas may be limited and subject to additional fees.

3.3 Cancellation Policy

  • Customers may cancel or reschedule services up to 24 hours before the scheduled appointment without penalty
  • Cancellations with less than 24 hours notice may be subject to a cancellation fee
  • Emergency services may have different cancellation terms

4. Pricing and Payment

4.1 Pricing

Service prices are based on factors including:

  • Type and scope of service required
  • Size and complexity of the AC system
  • Location and accessibility
  • Emergency or after-hours service requests

4.2 Payment Terms

  • Payment is due upon completion of services unless other arrangements are made
  • We accept cash, credit cards, and electronic transfers
  • Maintenance plan customers may be eligible for payment plans
  • Late payment fees may apply to overdue accounts

4.3 Estimates and Additional Work

Written estimates are provided free of charge. Any additional work required beyond the original scope will be discussed and approved before proceeding.

5. Customer Responsibilities

To ensure safe and effective service delivery, customers agree to:

  • Provide accurate information about their AC system and any known issues
  • Ensure safe and reasonable access to all areas requiring service
  • Remove valuable or fragile items from work areas
  • Inform us of any health concerns or allergies that may affect service
  • Be present or arrange for authorized representation during service
  • Provide payment as agreed upon completion of services

6. Warranties and Guarantees

6.1 Service Guarantee

We guarantee our workmanship for 30 days from the date of service completion. If you are not satisfied with our work, we will return to address any issues at no additional charge.

6.2 Parts and Materials

Any parts or materials provided carry manufacturer warranties. We will assist with warranty claims as applicable.

6.3 Limitations

Our warranties do not cover:

  • Normal wear and tear
  • Damage caused by customer misuse or neglect
  • Issues arising from inadequate maintenance
  • Problems with systems older than 15 years (limited warranty may apply)

7. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability for any claim shall not exceed the amount paid for the specific service
  • We are not liable for indirect, consequential, or punitive damages
  • We are not responsible for pre-existing conditions or system failures unrelated to our services
  • Our liability is limited to the repair or re-performance of defective services

We maintain comprehensive general liability and professional indemnity insurance to protect both our business and our customers.

8. Health and Safety

8.1 Safety Protocols

Our technicians follow strict safety protocols and use appropriate personal protective equipment. We comply with all applicable health and safety regulations.

8.2 Chemical Usage

All cleaning agents and disinfectants used are approved by Health Canada and are safe for residential use when applied correctly.

8.3 Indoor Air Quality

While our services aim to improve indoor air quality, we cannot guarantee specific health outcomes or complete elimination of all allergens or contaminants.

9. Intellectual Property

All content on our website, including text, graphics, logos, and images, is our property or used with permission. You may not reproduce, distribute, or create derivative works without written permission.

10. Privacy and Data Protection

11. Dispute Resolution

We encourage customers to contact us directly to resolve any concerns or disputes informally.

Any disputes that cannot be resolved informally will be subject to the laws of Ontario, Canada, and the exclusive jurisdiction of the courts of Ontario.

11.3 Mediation

Before pursuing legal action, parties agree to attempt mediation through a mutually agreed upon mediator.

12. Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters or severe weather
  • Government regulations or restrictions
  • Public health emergencies
  • Labor strikes or supply shortages
  • Equipment failures or transportation issues

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified Terms.

For significant changes, we will provide notice through our website or by email to customers with active service agreements.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
